UMOJA, a brand of RJT Services, operates this store and website, including all related information, content, features, tools, products and services, to provide you, the customer, with a curated shopping experience (the "Services"). UMOJA is powered by Shopify, which enables us to provide the Services to you. If there is a conflict between our Terms of Service and this Privacy Policy, this Privacy Policy controls with respect to the collection, processing and disclosure of your personal information.

Please read this Privacy Policy carefully. By using and accessing any of the Services, you acknowledge that you have read this Privacy Policy and understand the collection, use and disclosure of your information as described here.

Personal information we collect or process

When we use the term "personal information", we mean information that identifies or can reasonably be linked to you or another person. Depending on how you interact with the Services, where you live, and as permitted or required by applicable law, we may collect or process the following categories of personal information, including inferences drawn from it:

- Contact details, including your name, address, billing address, shipping address, phone number and email address.
- Financial information, including payment card information, financial account information, transaction details, form of payment, payment confirmation and other payment details.

- Account information, including your username, password, security questions, preferences and settings.
- Transaction information, including the items you view, add to your cart or wishlist, purchase, return, exchange or cancel, and your past transactions.

- Communications with us, including the information you include when you contact us, for example in a customer support request or when you approve a painting.
- Device information, including information about your device, browser or network connection, your IP address and other unique identifiers.

Sources of personal information
- Directly from you, when you create an account, visit or use the Services, communicate with us or otherwise provide us with personal information.
- Automatically through the Services, from your device when you use our Services or visit our website, including through cookies and similar technologies.
- From our service providers, when we engage them to enable certain technology and when they collect or process personal information on our behalf.
- From our partners or other third parties.

How we use your personal information
- Provide, tailor and improve the Services. If you register an account, you are responsible for keeping your credentials safe and should not share them with anyone.
- Communicating with you. To provide customer support, respond to you and maintain our relationship with you.

How we disclose personal information
In certain circumstances, we may disclose your personal information to third parties for legitimate purposes subject to this Privacy Policy, including:
- With Shopify, vendors and other third parties who perform services on our behalf, such as IT management, payment processing, data analytics, customer support, cloud storage, production of paintings by our partner workshops, fulfillment and shipping.
- With business and marketing partners, to provide marketing services and advertise to you. For example, we use Shopify to support personalized advertising with third party services based on your online activity with different merchants and websites. These partners use your information in accordance with their own privacy notices. Depending on where you live, you may have the right to ask us not to share information about you for targeted advertising. You can exercise this right here: https://umojastudio.com/pages/data-sharing-opt-out
- When you direct, request or otherwise consent to our disclosure of certain information to third parties, such as to ship you products or through social media widgets or login integrations.
- In connection with a business transaction such as a merger or bankruptcy, to comply with applicable legal obligations (including subpoenas, search warrants and similar requests), to enforce our terms or policies, and to protect the Services, our rights and the rights of our users or others.

Relationship with Shopify
The Services are hosted by Shopify, which collects and processes personal information about your access to and use of the Services to provide and improve them. Information you submit to the Services is transmitted to and shared with Shopify and with third parties that may be located in countries other than where you live. To help protect, grow and improve our business, we also use certain Shopify enhanced features that use data from your interactions with our store, with other merchants and with Shopify. For these purposes, Shopify is responsible for the processing of your personal information, including for responding to your requests to exercise your rights. To learn more, visit the Shopify Consumer Privacy Policy: https://www.shopify.com/legal/privacy/app-users. Depending on where you live, you may exercise certain rights through the Shopify Privacy Portal: https://privacy.shopify.com/en

Third party websites and links
The Services may link to websites or platforms operated by third parties. If you follow these links, please review their privacy and security policies and terms. We are not responsible for the privacy or security of these sites or for the accuracy of their content. Information you share on public or semi public venues, including third party social networks, may be visible to other users. Including a link does not, by itself, imply any endorsement.

Children's data
The Services are not intended for children, and we do not knowingly collect personal information about children under the age of majority in your jurisdiction. If you are the parent or guardian of a child who has provided us with personal information, contact us to request its deletion. We have no actual knowledge that we "share" or "sell" (as defined by applicable law) the personal information of individuals under 16 years of age.

Security and retention
No security measure is perfect, and we cannot guarantee perfect security. Information you send to us may not be secure while in transit, so we recommend that you do not use unsecure channels to send sensitive or confidential information.
We keep your personal information only as long as necessary: to manage your account, provide the Services, comply with our legal obligations (for example, accounting and tax records), resolve disputes and enforce our agreements.

Your rights and choices
Depending on where you live, you may have some or all of the following rights. These rights are not absolute, may apply only in certain circumstances, and we may decline a request where permitted by law.
- Right to access or know the personal information we hold about you.
- Right to delete the personal information we hold about you.
- Right to correct inaccurate personal information.
- Right of portability: to receive a copy of your personal information and ask us to transfer it to a third party, in certain circumstances.
- Right to opt out of sale or sharing for targeted advertising, as defined by applicable privacy laws. You can exercise this right here: https://umojastudio.com/pages/data-sharing-opt-out. If you visit our website with the Global Privacy Control signal enabled, depending on where you are, we treat it as an opt out request for that device and browser, and for the linked Shopify account where possible. Learn more at https://globalprivacycontrol.org/. We do not recognize other "Do Not Track" signals.
- Managing communication preferences: you can unsubscribe from our promotional emails at any time using the link in each email. We may still send you non promotional emails about your account or orders.

If you live in the United Kingdom or the European Economic Area, subject to local law, you also have the following rights:
- Objection and restriction: to ask us to stop or restrict the processing of your personal information for certain purposes.
- Withdrawal of consent: where we rely on your consent, you can withdraw it at any time, without affecting processing carried out before.

You can exercise these rights where indicated on the Services or by contacting us using the details below. We will not discriminate against you for exercising your rights. We may need to verify your identity before processing a request. You may designate an authorized agent to make requests on your behalf, in which case we will ask for proof of authorization and may verify your identity directly. We will respond within the time required by applicable law.

Complaints
If you have a complaint about how we process your personal information, please contact us first using the details below. Depending on where you live, you may appeal our decision or lodge a complaint with your local data protection authority. In France, you can contact the CNIL (www.cnil.fr). For the European Economic Area, the list of data protection authorities is available here: https://edpb.europa.eu/about-edpb/about-edpb/members

International transfers

We may transfer, store and process your personal information outside the country where you live. When we transfer personal information out of the European Economic Area or the United Kingdom, we rely on recognized transfer mechanisms such as the European Commission's Standard Contractual Clauses or their UK equivalent, unless the destination country provides an adequate level of protection.
